- What is a mental health warrant?
Any adult may file an application with a magistrate, including a justice court judge, for a mental health warrant
The adult who files the application is known as the applicant.
The applicant will answer questions and state the reasons why the person needs mental health treatment, and how they have been a danger to themselves or others. - What does a mental health warrant do?
A mental health warrant issued by a magistrate orders a peace officer to detain the person and take them to an inpatient mental health facility for an evaluation for their need for treatment. It does not guarantee admission to a facility or require that someone stay there for a period of time. - What is required for an application for a mental health warrant to be approved by a magistrate?
After the application is filed with a magistrate, in order to be approved, the magistrate must find that there is reasonable cause to believe that the person you are trying to commit evidences mental illness or evidences a substantial risk of serious harm to himself or others; that intervention by the Court is necessary because the risk of harm will be imminent unless the person is immediately restrained; and the necessary restraint cannot be accomplished without emergency detention.
